These Terms of Use (“Terms”) govern MILEARC (the “App”). By using the App, you agree to these Terms.
1. Service Description
Based on your current location, desired distance, and selected conditions, the App proposes a loop route that returns to the starting point and provides map display, course saving, and guidance.
The App does not limit movement to a particular sport. It is not intended for emergency calls, lifesaving, search and rescue, or automatic vehicle control.
2. Courses and Map Information
Proposed courses and evaluation results are based on external data such as Apple Maps, OpenStreetMap, the Geospatial Information Authority of Japan, and Geoapify, as well as device location information.
Distance, routes, elevation change, intersections, traffic signals, stairs, paving, parks, waterfront areas, place names, and other information may be missing, delayed, or inaccurate. Construction, road closures, private land, opening hours, disasters, weather, and actual road conditions can change at any time.
The App does not guarantee that a course is passable, safe, accurate, complete, or suitable for a particular purpose. Always follow local signs, laws, facility instructions, and actual conditions.
3. Safe Use
Pay attention to your surroundings while moving and do not stare at the screen. Decide whether to change or stop using a course based on your health, experience, equipment, weather, and traffic conditions.
If the App suggests a dangerous, impassable, or inappropriate place, do not enter it and move to a safe location. Do not use the App as your only means of communication or guidance in an emergency.
4. Connectivity and External Services
Course creation, map display, and retrieval of elevation and road attributes require an internet connection and external services. Some or all functions may become unavailable because of connectivity, maintenance, usage limits, or specification changes.
5. MILEARC Plus and Auto-Renewal
MILEARC Plus is an auto-renewable subscription that removes the course-creation limit. The free version currently allows 30 course creations. The free allowance may be changed through a public configuration. Courses already saved on the device remain available after Plus ends.
Prices and periods for Japan are:
- Monthly plan: ¥200 per month, for one month from the purchase date
- Annual plan: ¥1,500 per year, for one year from the purchase date
Prices may change. The price, period, free trial, and conditions shown by the App Store at purchase confirmation control.
Payment is charged to your Apple Account at purchase confirmation. Unless auto-renewal is disabled at least 24 hours before the current period ends, the subscription renews for the same period and price, and the renewal charge is made within 24 hours before the period ends.
To disable auto-renewal or check the next renewal date, open iPhone Settings > Apple Account > Subscriptions > MILEARC. Deleting the App does not cancel the subscription. After cancellation, Plus remains available until the current paid period ends.
Purchases can be restored from “Restore Purchases” in the App. Refunds and other purchase management follow Apple’s procedures. The App does not obtain or store your Apple Account, payment method, or card information.
6. Prohibited Conduct
The following conduct is prohibited:
- Use that violates laws, public order, or the rights of others
- Placing an excessive load on the App, external services, or communications infrastructure
- Unauthorized access, analysis, alteration, interference, or misuse
- Copying, selling, or redistributing the App or its content without permission
7. Intellectual Property
Rights in the App’s original design, text, software, and other content belong to the developer or applicable rights holders. Maps and external data are subject to their providers’ copyright, license, and attribution requirements.
8. Disclaimer and Limitation of Liability
The App is provided as is. To the extent permitted by law, the developer is not liable for losses arising from use or inability to use the App, proposed courses, errors in maps, elevation or road attributes, data loss, communication failures, or unavailable external services.
This does not apply where liability cannot be limited under applicable law.
9. Changes to the Service and These Terms
The App or these Terms may be changed for feature improvements, changes to external services, legal compliance, or other reasons. Material changes will be announced in the App.
10. Governing Law
These Terms are governed by and interpreted under the laws of Japan.
